General Terms and Conditions for Axkid US Online Shop
1. Introduction
1.1 These General Terms and Conditions (“Terms”) govern the purchase and sale of products via the Axkid website (www.axkid.com/us) and apply to any contract entered into between the customer (“you” or “the Customer”) and Axkid Inc., a company incorporated under the laws of the State of Delaware with principal office located at 4550 Linden Hill Rd, Wilmington, DE 19808, United States (“Axkid,” “we,” “our,” or “us”).
1.2 By accessing our website or placing an order, you acknowledge that you have read, understood, and accepted these Terms. If you do not agree to these Terms, you must refrain from using the website or placing orders through it.
2. Customer Eligibility
2.1 By placing an order through our website, you represent and warrant that:
- You are a natural person acting outside your trade or professional capacity;
- You are a resident of the United States;
- You are legally capable of entering into binding contracts;
- You are at least 18 years of age; and
- The products purchased are intended solely for personal use and not for resale or rental.
3. Formation of Contract
3.1 Product listings on our website do not constitute binding offers but are invitations to make an offer.
3.2 By clicking “Order now” during the final step of the checkout process, you are submitting a legally binding offer to purchase the items listed in your order summary. A contract shall only be formed upon our confirmation of your order via email.
3.3 You may select products and place them in your virtual shopping cart. You can modify or cancel your selection at any point prior to submitting your order. By submitting your order, you agree to be bound by these Terms.
3.4 If we are unable to accept your order, including due to unavailability of stock, we will notify you promptly via email and issue a full refund, including any shipping fees paid.

4. Order Confirmation

6.1 Prices are listed in U.S. dollars and are exclusive of applicable sales tax, which will be calculated based on the delivery address.
6.2 Despite our efforts to ensure accuracy, some pricing errors may occur. In such cases, if the actual price is lower than advertised, you will be charged the lower amount. If higher, we will contact you for confirmation before proceeding.
6.3 Prices are subject to change; however, no price change will affect confirmed orders.
6.4 Payment must be made in full at the time of order via approved payment methods, including but not limited to Stripe and PayPal. Payment processing is subject to the terms of the relevant payment provider.
6.5 You are responsible for maintaining accurate and up-to-date account and payment information. Axkid is not liable for delays or losses resulting from incorrect information.
7. Shipping Charges
7.1 Shipping fees will be clearly displayed during the checkout process and are in addition to product pricing.
8. Retention of Title
8.1 All products remain the property of Axkid until full payment has been received. We reserve the right to withhold shipment until payment is confirmed. Unpaid items may be reclaimed.
9. Delivery
9.1 Products will be delivered in accordance with the order confirmation.
9.2 We endeavor to dispatch products within thirty (30) days of confirming the order. Estimated delivery times will be shown at checkout.
9.3 Delays caused by circumstances beyond our control will not render us liable. In such cases, we will notify you and, where delay is material, you may cancel the order and receive a full refund.
9.4 We may ship items separately if some products are unavailable. You may elect to receive a partial refund or wait for backordered items.
9.5 You are responsible for providing accurate delivery information. If delivery fails due to your error, we may cancel your order and deduct applicable shipping costs from your refund.
9.6 If a product is no longer available, we may cancel the affected portion of your order and issue a full refund or suggest a similar alternative.
9.7 Responsibility and risk of loss for ordered products transfers to you upon delivery.
10. Right of Withdrawal
10.1 As a consumer, you have the right to withdraw from the contract within fourteen (14) days of receiving the product, for any reason.
10.2 Returned items must be unused, undamaged, and in original packaging. Return shipping costs are your responsibility.
10.3 Notify us of your intention to withdraw by submitting a completed return request form available on our website.
10.4 Items must be returned within 14 days of such notification.
10.5 Refunds will be issued within 14 days of receiving the returned items, provided they are in satisfactory condition. Refunds will be made to your original payment method.
10.6 Axkid reserves the right to reduce refunds for products showing signs of use or damage.
10.7 If you wish to make a change to your order after submission, contact us at support.na@axkid.com. Changes are subject to our approval and may affect pricing or delivery.
11. Faulty or Non-Conforming Products
11.1 You may return products that are defective or not as described within 14 days of receipt for a replacement or full refund.
11.2 For defects discovered after this period but within two (2) years of delivery, you may request a repair or replacement. If this is not feasible, a refund will be provided.
11.3 Axkid reserves the right to deny claims arising from misuse or improper handling.
11.4 Refunds for faulty products will include the full product cost and applicable standard shipping charges and shall be processed within thirty (30) days of confirming the fault.
12. Liability and Limitation of Liability
12.1 We warrant that any product purchased through our website shall be of satisfactory quality and reasonably fit for its intended purpose, consistent with products of the same type.
12.2 Our products are offered exclusively for domestic and private use. We shall not be held liable for any indirect, consequential, or incidental damages including, but not limited to, loss of profit, loss of business, business interruption, or loss of business opportunity. Furthermore, we expressly disclaim liability for any loss or damage incurred as a result of any breach by you of these Terms.

13.2 We reserve the right to assign or transfer our rights and obligations under these Terms to any affiliated entity or third party.

13.4 These Terms create rights and obligations only between you and Axkid. No third party shall have the right to enforce any provision of these Terms.

13.6 You may bring legal proceedings with respect to the products in the courts of Sweden.
13.7 These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them shall be governed by and construed in accordance with the laws of Sweden.
13.8 If your habitual residence is within a member state of the European Union, these Terms shall be subject to Swedish law, provided that such application does not override any mandatory provisions of the laws of your country of residence.
